We were under contract, and the transaction was delayed due to survey-related issues outside our control; during that period, the contract was treated and represented as active. Once the survey was completed, the seller decided not to close and denied signing an extension, along with repeated delays on the seller’s end regarding extensions and completion of agreed repairs. We were then placed in a position where closing was expected without a final walkthrough being completed, despite repairs still being outstanding and never being waived by us. Since I can’t respond directly to the owner’s reply, I’m addressing this here. Alejandra represented the seller of the property we were under contract to purchase. It’s been claimed that they didn’t deal with me directly; however, the record reflects otherwise. After I sent a demand for specific performance, we immediately received a signed contract extension. If the contract had truly expired, there would have been no reason—or ability—for the seller to sign an extension at that point. We were told the extension was handled and that the deal was moving forward. If earlier extensions were not signed, that should have been disclosed at the time—not used later as justification.
