Three times we had our home on the market, two different agents and FSBO. We gave up for a year or two. Our son had a similar experience. Both the Tennessee Residential Property Disclosure Act and the Tennessee Real Estate Broker License Act require a real estate agent to disclose facts of which the agent has actual knowledge or NOTICE. Several stair step cracks in a brick foundation, many cracks in the drywall, and interior stairs pulling away from the wall were all made aware to an agent working for this agency during an open house. We were told later that evening by the agent that a structural engineer previously determined that these were cosmetic issues and we would be given a copy of the engineer’s report the next day.
